Definitions

Below are the definitions for capitalized terms that appear in the Terms of Use, Wedding Services Contract, Terms of Facilitation, and Privacy Policy. Other terms may be defined within the body of these agreements and are capitalized in quotation marks.
Agreement - refers to the document in which the word “Agreement” appears.
Capture - means to Photograph, Film or record Audio as applicable.
Client - means a User of the Platform who has entered into a Wedding Service Contract with a Shooter by way of the EVOKE Platform.
Event Gallery - means a webpage hosting the Shooter’s final Works for an Event.
Event - means an occasion whereby Shooter has a contractual obligation (by way of a Wedding Service Contract) to provide Photography or Video service for a Client, including but not limited to a; wedding, reception, bridal session, engagement session, rehearsal dinner, and cultural occasions such as Japanese Tea Party, Indian Mehndi Party, and similar.
Limited Copyright Agreement - narrowly defines the terms by which Works created by the Shooter in connection with a Wedding Service Contact can be used. Specifically, Shooter and EVOKE agree to use the Works solely and exclusively for the purpose of marketing Shooter’s services offered on the EVOKE Platform or in connection with marketing EVOKE in a general way.
Platform - refers collectively to the EVOKE website (www.evokephotoandvideo.com), EVOKE’s mobile application (“App”), and related systems and software.
Proposal Total - refers to the total amount of money Client agrees to pay Shooter for services listed on the Proposal.
Retainer Fee - is the initial payment made by the Client to secure the Shooter's services.
Shooter - means a User of the Platform who seeks to market and sell their wedding photography and/video services to other Users, by way of the EVOKE Platform.
Wedding Service Contract - refers to the contract between Shooter and Client for services provided by Shooter in consideration for payment from Client.
Works - means all photographs, video clips, audio files (both original or RAW files) and any derivative creations produced therefrom.
